Terms and Conditions

These terms govern your use of Twende Tribe. Please read them carefully before creating an account, joining a trip, or using group travel and contribution features.

1. Agreement to these terms

These Terms and Conditions ("Terms") form a binding agreement between you and Twende Tribe ("Twende Tribe", "we", "us" or "our") when you access or use our mobile application, website, APIs, communications, and related services (together, the "Service").

By creating an account or using the Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, do not create an account or use the Service.

2. Who may use Twende Tribe

You must be at least 18 years old and legally capable of entering a contract. If you use the Service for an organisation or group, you confirm that you have authority to bind that organisation or group.

You must provide accurate, current information and keep it updated. We may request reasonable verification where needed to protect users, comply with law, or prevent fraud.

3. What the Service does

Twende Tribe helps people organise group travel, coordinate participants, plan shared activities, track expected contributions, and view payment or disbursement information supplied by users and integrated providers.

Unless we expressly state otherwise for a specific regulated service, Twende Tribe is not a bank, deposit-taking institution, insurer, travel agent, trustee, escrow provider, or licensed payment service provider. We do not hold deposits or take ownership of group funds. Payments may be processed by independent banks, mobile-money operators, payment providers, or organisers under their own terms.

4. Your account and security

You are responsible for activity under your account and for keeping your password, verification codes, and device access secure. Do not share credentials or allow another person to impersonate you.

Tell us promptly at support@twendetribe.africa if you suspect unauthorised access. We may temporarily restrict an account to investigate suspected fraud, abuse, legal risk, or a security incident.

5. Group organisers and member responsibilities

Organisers are responsible for the accuracy of trip details, budgets, deadlines, invitations, participant communications, and instructions they publish. Members are responsible for reviewing trip information before committing funds or making travel arrangements.

A group’s internal decisions, refunds, cancellations, substitutions, and disputes remain between its organiser and members unless a separate written Twende Tribe service expressly says otherwise. We may provide records or tools to help resolve a dispute, but we are not required to decide it.

6. Payments and third-party providers

Payment availability, settlement times, reversals, limits, fees, exchange rates, and outages may be controlled by third-party providers such as mobile-money operators or banks. Their terms and privacy notices also apply.

You authorise us to send transaction instructions and receive status information when you initiate a supported payment. A status shown in the Service may be delayed or corrected after reconciliation. Keep independent payment confirmations and report discrepancies promptly.

  • Do not send money outside the displayed or verified payment flow solely because another user asks you to.
  • You are responsible for taxes, charges, and lawful source of funds that apply to your transactions.
  • We may reject, delay, or flag activity where required by law, provider rules, fraud controls, sanctions, or technical safeguards.

7. Cancellations, refunds, and travel risk

Trip cancellation and refund rights depend on the organiser’s disclosed rules and the terms of airlines, accommodation providers, venues, payment providers, and other suppliers. Twende Tribe does not guarantee a refund unless we expressly made the relevant charge and applicable law requires one.

Travel carries risks, including injury, illness, delay, loss, weather disruption, and changes in entry requirements. You are responsible for assessing suitability, obtaining required documents and insurance, and following official health, safety, immigration, and travel guidance.

8. Acceptable use

You must use the Service lawfully and respectfully. You must not:

  • commit or facilitate fraud, money laundering, terrorism financing, scams, harassment, discrimination, exploitation, or any unlawful act;
  • upload false, infringing, malicious, obscene, or deceptive content;
  • attempt to access another account, bypass safeguards, probe vulnerabilities, introduce malware, scrape the Service, or overload our systems;
  • use another person’s identity, payment details, or personal data without lawful authority;
  • misrepresent a trip, contribution, refund, affiliation, endorsement, or payment status; or
  • use the Service in a way that violates the Computer Misuse and Cybercrimes Act, 2018, the Kenya Information and Communications Act, the Consumer Protection Act, 2012, or other applicable law.

9. User content and permissions

You retain ownership of content you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, copy, process, display, and transmit that content only as needed to operate, secure, improve, and promote the Service in accordance with your settings and our Privacy Policy.

You confirm that you have the rights and permissions needed to submit the content, including personal information about invited members. We may remove or restrict content that violates these Terms, another person’s rights, or applicable law.

10. Our intellectual property

The Service, including its software, brand, design, text, graphics, and non-user content, belongs to Twende Tribe or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable right to use the Service for its intended purpose.

You may not copy, sell, license, reverse engineer, modify, or create derivative works from the Service except where applicable law does not permit that restriction.

11. Availability and changes

We work to keep the Service reliable but do not promise uninterrupted or error-free access. We may maintain, update, suspend, or change features to improve safety, comply with law, respond to provider changes, or develop the Service.

Where a change materially reduces a core paid service, we will provide reasonable notice where practicable and honour any rights required by applicable consumer law.

12. Suspension and termination

You may stop using the Service and request account deletion. We may suspend or terminate access where you materially breach these Terms, create risk or harm, fail verification, or where restriction is required by law or a provider.

Where appropriate, we will give notice and an opportunity to appeal. Provisions concerning ownership, liability, disputes, records, and obligations that logically continue will survive termination.

13. Disclaimers and liability

To the extent permitted by law, the Service is provided on an “as available” basis. We do not guarantee the conduct of users, the quality or safety of a trip, supplier performance, uninterrupted third-party payments, or the accuracy of user-submitted content.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, or rights protected by applicable consumer law. Subject to that rule, we are not liable for indirect, incidental, special, punitive, or consequential losses, or for losses caused by another user, organiser, supplier, payment provider, or event outside our reasonable control.

14. Indemnity

To the extent permitted by law, you will reimburse Twende Tribe for reasonable losses, claims, and costs arising from your unlawful use of the Service, your breach of these Terms, or content you submit. This does not apply to loss caused by our own negligence, breach, or unlawful conduct.

15. Governing law and disputes

These Terms are governed by the laws of Kenya. First contact support@twendetribe.africa so we can try to resolve a concern promptly. If it is not resolved, the courts of Kenya will have jurisdiction, subject to any mandatory consumer right to bring a claim in another competent forum.

Nothing here limits your right to contact a regulator, consumer-protection authority, the Office of the Data Protection Commissioner, or another body with lawful authority.

16. Changes and contact

We may update these Terms. We will post the revised version and update the date above. If a change materially affects your rights, we will provide prominent notice and, where legally required, ask you to agree again. Continued use after the effective date of a non-material update means the revised Terms apply.
